I read it a little differently in that "Action tests" refer to tests that require an action on your part (major or minor). So it wouldn't apply to things like defense tests, soak tests, drain tests, surprise tests, ect.

Yeah, that's why I mentioned you can defend that the 'reduce damage/power' rolls aren't Tests but Resistance rolls and intended to be excluded from the penalties. There's no 100% clarity but it's a likely thing.
